These Terms of Service govern your use of Doitong (doitong.com), an AI video-creation platform (the "Service") operated by SPACEFOX UNIPESSOAL LDA.

SPACEFOX UNIPESSOAL LDA, a company registered in Portugal (Tax ID: 519184963), with registered address at Rua das Glicinias N22, 2865-769 Fernao Ferro, Portugal, offers its services to you, a user, under the condition that you accept all of our set terms, including these Terms of Service and all related policies.

Thank you for choosing SPACEFOX UNIPESSOAL LDA's content repurposing services (the "Services"). These Terms of Service (the "Agreement") outline your rights in relation to the content generated through the Services, including various engaging formats transformed from your original content (the "Assets"), your use of the Services, and other important topics such as arbitration. We urge you to read this Agreement carefully. Our privacy policy, which details how we handle your data, is an integral part of this Agreement. This Agreement is made between SPACEFOX UNIPESSOAL LDA and the entity or person agreeing to these terms ("Customer"), and it governs the Customer's access to and use of the Services.

This Agreement becomes effective when the Customer is presented with this Agreement and begins using the Services (the "Effective Date"), or when they receive or distribute Assets created via the Services. These terms may be updated periodically and will be presented to the Customer again for review. Continued use of the Services signifies acceptance of any updated terms. If you do not agree to the terms of this Agreement, please discontinue your use of the Services.

Additional documents referenced in this Agreement, including Community Guidelines outlined below, may also govern the Customer's use of the Services.

1. Service Availability and Quality

We are continuously improving SPACEFOX UNIPESSOAL LDA's Services to enhance your experience. The Services are subject to ongoing development and change, which may include adjustments to the AI technology used for content transformation, the types of content handled, output formats, and features available to the Customer. However, we make no guarantees regarding the Services' quality, stability, uptime, or reliability. Please refrain from creating any dependencies on specific attributes of the Services or the Assets generated. SPACEFOX UNIPESSOAL LDA will not be liable for any harm resulting from your reliance on the Services.

Both the Services and the Assets are provided to the Customer on an "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied. This includes, but is not limited to, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You bear the sole responsibility for assessing the suitability of using or redistributing the Assets and assume all risks associated with the use of the Services.

SPACEFOX UNIPESSOAL LDA reserves the right to suspend or terminate your access to the Services at any time, for any reason. The Services must not be used for competitive research or reverse engineering. Automated tools for accessing, interacting with, or generating Assets through the Services are prohibited. Each registered account on SPACEFOX UNIPESSOAL LDA is for individual use only; multiple accounts for a single user are not permitted. We reserve the right to investigate any complaints or reported violations of our Terms of Service and to take appropriate action. This action may include reporting suspected unlawful activities to law enforcement, regulators, or other relevant third parties, and disclosing user-related information necessary for these purposes.

2. Age Requirements

You must be at least 18 years old to use the Services. The Services are not intended for children, and we do not knowingly allow anyone under 18 to create an account. If we learn that an account belongs to someone under 18, we will close it and delete its data.

3. Your Information

By using SPACEFOX UNIPESSOAL LDA's Services, you may provide SPACEFOX UNIPESSOAL LDA with personal information, such as your email address, user name, billing information, content preferences, outputs generated, and text prompts that you enter, or content that you upload to the Service. Our policy, which details how we handle your personal information and the rights you have concerning your personal information, can be found here. Both parties agree to comply with all applicable data protection laws. Should there be a need to establish additional terms regarding data privacy or data transfers, both parties will collaborate in good faith to agree upon such terms.

4. YouTube Terms of Service

YouTube API Services: This application uses YouTube API Services. By using our Services that interact with YouTube (including but not limited to video uploads, video searches, and content management), you agree to be bound by the YouTube Terms of Service available at https://www.youtube.com/t/terms .

Additionally, please review Google's Privacy Policy at https://policies.google.com/privacy to understand how Google handles your data when you use YouTube services through our application.

5. Your Content and Our Licence

To the extent permitted by law, you own the content you upload to the Services (the "Uploads") and the content you generate with them (the "Generations"). SPACEFOX UNIPESSOAL LDA does not claim ownership of your Uploads or Generations.

You grant SPACEFOX UNIPESSOAL LDA a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display your Uploads and Generations only as needed to operate, secure and provide the Services to you — for example, to generate, save, show, back up and deliver your content, including through apps you connect to your account, such as Claude or ChatGPT. This licence ends when you delete the content or your account, except for copies we must keep by law or that remain for a limited time in backups.

We will not sell your Generations or use them in advertising without your separate consent. Similar or identical Generations may be created by other users with their own inputs; your rights cover the specific Generation you created. If you break these Terms or our Content Policy, we may remove the affected content.

6. People in Your Content

You may upload a photo, video or voice recording of a real person, or ask the Services to depict or imitate a real person, only if that person has given you their consent. You must not use the Services to impersonate someone, to deceive others about who said or did something, to harass anyone, or to create sexual content involving a real person. We may remove such content and suspend or close the account.

7. Dispute Resolution and Governing Law

All legal claims arising out of or relating to this Agreement (including any dispute regarding the interpretation or performance of the Agreement) ("Dispute") will be governed by the laws of Portugal.

The parties agree to attempt in good faith to settle any Dispute within 30 days after the Dispute arises. Should the Dispute not be resolved within this period, it shall be resolved by arbitration conducted by the Lisbon Arbitration Centre (Centro de Arbitragem de Lisboa), in accordance with its Arbitration Rules in force as of the date of this Agreement ("Rules").

The arbitration process will involve the mutual selection of one arbitrator and will be conducted in English in Lisbon, Portugal.

Either party may seek injunctive relief from any competent court to protect its rights pending the resolution of the arbitration. The arbitrator is also empowered to order equitable or injunctive relief consistent with the remedies and limitations in this Agreement.

The decision made in arbitration will be final and binding on both parties, and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property.

Each party will be responsible for its own legal fees and expenses, regardless of the arbitrator's final decision on the Dispute.

8. Ownership

Customer Ownership: You keep full ownership of all content — including text, images, video, audio and data — that you upload, store, transmit or generate through our platform. Apart from the limited licence in section 5, SPACEFOX UNIPESSOAL LDA claims no rights in your content or data.

Non-Usage Without Explicit Consent: We are dedicated to respecting your privacy and securing your content and data. We will not use, sell, rent, or otherwise exploit your content or data without obtaining your explicit consent.

Consent for Specific Purposes: In certain circumstances, we may seek your explicit consent to use your content or data for specific purposes. These purposes will be outlined in separate agreements, features, or functionalities within our services. Such consent will be obtained separately, and we will only use your content or data as per the specific consent provided.

Limited Data Processing: We may process your content and data solely for the purpose of providing our services to you. This includes, but is not limited to, storage, retrieval, backup, and data analysis, in compliance with applicable privacy laws and regulations.

Data Security Measures: Reasonable security measures are employed to protect your content and data from unauthorized access, disclosure, alteration, or destruction. However, no internet transmission or electronic storage method is 100% secure, and we cannot guarantee absolute security.

Third-Party Access: Access to your content or data will not be provided to third parties, except as required by law, to comply with legal obligations, enforce our rights, prevent fraud, or protect the rights, property, or safety of our users.

Data Deletion: Upon your request or termination of your account, we will delete your content and data from our active databases, subject to any legal obligations or technical limitations. Please note that residual copies of your content or data may remain in our backup systems for a limited period.

9. Payment and Billing

We may invoice you for your use of SPACEFOX UNIPESSOAL LDA's Services through a third-party payment service provider. You can cancel your subscription plan at any time; it then stays active until the end of the current billing period and is not renewed. SPACEFOX UNIPESSOAL LDA may suspend or terminate your access to the Services for violations of these Terms, the Community Guidelines or other inappropriate use of the Services.

Refunds: Refunds are governed by our Refund Policy, which is part of these Terms. In short: you can request a refund within 14 calendar days of a purchase by writing to [email protected]. Credits you have not used are refunded; credits already spent on generations are not, because that service was performed at your request, so a partly used purchase is refunded pro rata. Refunds go back to the original payment method. Purchases made through the Apple App Store, Google Play or another app store are refunded by that store under its own rules, and purchases paid in Russian roubles are governed by the Russian public offer.

Right of Withdrawal (EU Consumers): Under EU consumer protection law you may withdraw from a purchase within 14 days without giving any reason. When you start using the Services (for example, by generating content), you ask us to begin performing the service immediately and acknowledge that you lose the right of withdrawal for the part of the service already performed. The unused part is refunded as described in the Refund Policy.

10. Limitation of Liability and Indemnity

SPACEFOX UNIPESSOAL LDA is provided on an "as is" basis, and we make no representations or warranties of any kind regarding the Services. You understand and agree that SPACEFOX UNIPESSOAL LDA will not be liable for any loss of profits, use, goodwill, or data, nor for any incidental, indirect, special, consequential, or exemplary damages, regardless of how they arise. You are solely responsible for your use of the Services. In the event that your actions cause harm to another party or lead to a dispute, SPACEFOX UNIPESSOAL LDA will not be involved. Furthermore, if you knowingly infringe upon someone else's intellectual property rights, resulting in financial loss to us, you will be held responsible for that loss. This may include reimbursing us for any costs incurred, including legal fees. It is imperative to respect the intellectual property rights of others when using our Services.

11. Miscellaneous

Force Majeure: Neither party will be held liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, terrorism, riots, or war.

No Agency: This Agreement does not create any form of agency, partnership, or joint venture between the involved parties.

Severability: If any portion of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions of the Agreement will continue in full force and effect.

No Third-Party Beneficiaries: This Agreement is not intended to, and does not, confer any rights or remedies upon any person or entity other than the parties to this Agreement, unless explicitly stated otherwise.

Survival: Certain sections and obligations within this Agreement are intended to survive the termination or expiration of this Agreement, including but not limited to provisions related to intellectual property and privacy.

12. Online Dispute Resolution (EU)

In accordance with Regulation (EU) No 524/2013, the European Commission provides an online dispute resolution platform for consumers residing in the European Union. You can access this platform at https://ec.europa.eu/consumers/odr . This platform can be used to resolve disputes arising from online contracts. 13. Chrome Extension (Cinematic Recorder)

The Cinematic Recorder Chrome Extension is an integral part of the Service. By installing and using the Extension, you agree to the following additional terms:
